These Terms of Service ("Terms") govern your use of the ScaleProxy website (scaleproxy.com) and proxy services ("Service") operated by ScaleProxy ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use our Service.
ScaleProxy provides unmetered residential proxy services, including access to a pool of residential IP addresses for use with HTTP, HTTPS, and SOCKS5 protocols. Our Service includes features such as geo-targeting, IP rotation, and concurrent connection management as described on our website and in your selected plan.
We reserve the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes where practicable.

Pricing is listed in US Dollars (USD). We offer both monthly and annual billing cycles. Annual billing provides a discount equivalent to two months free (approximately 17% savings).
We make the following service commitments to our customers. These guarantees are subject to the conditions described below.
Your plan's maximum speed is determined by the published formula: concurrent threads × 2 = maximum Mbps. If your measured speeds fall below 50% of your plan's published maximum speed for a continuous period of more than 24 hours, we will issue a service credit to your account. Credits are applied to future invoices and are not redeemable for cash.
This guarantee does not apply where speed reduction is caused by factors outside our control, including but not limited to: target website restrictions, your local network conditions, or ISP-level throttling.
We guarantee 99.9% uptime for our proxy infrastructure in any calendar month. If we fail to meet this target, we will automatically apply a service credit to your account proportional to the downtime experienced. No support ticket is required.
"Uptime" refers to the availability of our proxy endpoints. Scheduled maintenance windows, which we will announce in advance where possible, are excluded from uptime calculations.
The monthly or annual rate at which you subscribe is guaranteed for 12 months from your subscription start date. During this period, we will not increase your rate, add overage charges, or introduce per-geography surcharges on your existing plan.
This guarantee applies to your current plan and billing cycle. If you change plans, the pricing for your new plan applies. After the 12-month period, pricing may be adjusted with at least 30 days' written notice.
All service credits issued under our guarantees are applied as account credits toward future service fees. Credits are not transferable, not redeemable for cash, and expire 12 months from the date of issue. Maximum total credits in any billing period shall not exceed the fees paid for that period.
We offer a trial for $10 USD for 10 days ("the $10 for 10 days trial"). The trial provides:

We offer a 10-day money-back guarantee on all subscription plans. If you are not satisfied with our Service within 10 days of your subscription start date, you may request a full refund of your subscription fee.
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:
We may suspend or terminate your account under the following circumstances:
Where practicable and not prohibited by law, we will provide notice before suspension or termination and an opportunity to address the issue. If your account is terminated for reasons other than Acceptable Use violations, we will refund any prepaid fees for the unused portion of your subscription on a pro-rata basis.
The ScaleProxy name, logo, website design, and all related content are our intellectual property or used under licence. You may not copy, modify, distribute, or create derivative works from our content without our written permission.
Your use of our Service does not grant you any intellectual property rights in our Service or the technology underlying it.

Except for the specific guarantees set out in Section 5 (Speed Guarantee, Uptime Guarantee, and Locked-In Pricing), the Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we disclaim all other warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted (beyond our 99.9% uptime commitment), error-free, or free of harmful components. We do not guarantee specific success rates, IP quality scores, or compatibility with any particular target website or platform.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
You agree to indemnify, defend, and hold harmless ScaleProxy and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. Either party may initiate this process by providing written notice to the other party describing the dispute and proposed resolution.
We may update these Terms from time to time. We will notify you of material changes by:
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree with the updated Terms, you should cancel your subscription before the changes take effect.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScaleProxy regarding the use of our Service and supersede all prior agreements, representations, and understandings.
